H-1B Visa
What is an H-1B Visa?
The H-1B visa is a temporary work visa for foreign professionals employed by U.S. companies. Beneficiaries of H-1B can work in the U.S. for a total of six years, with each approval granted for up to three years.
Who Can Apply for an H-1B Visa?
The applicant for an H-1B visa is a U.S. employer, not the employee. The employee is the beneficiary of the H-1B application. Both the employer and employee must meet specific requirements:
Employer:
-
Must demonstrate a genuine employment relationship with the foreign employee.
-
Must have the ability to pay wages.
-
The job position offered to the foreign employee must be a legitimate position.
Employee:
-
Job Position: The position held by the beneficiary should be a "professional position," typically requiring at least a bachelor's degree or higher; or the job is so specialized and complex that only an individual with a degree can perform the duties.
-
Educational Background: Possess a bachelor’s degree or higher degree from a U.S. accredited university, or its foreign equivalent.
How Long Does it Take to Approve an H-1B Application?
Generally, USCIS requires 3 to 6 months to process an H-1B visa application, starting from the date the application is received.
