What is an H-1B Visa?
The H-1B visa is a temporary work visa for foreign professionals employed by U.S. companies. Beneficiaries of H-1B can work in the U.S. for a total of six years, with each approval granted for up to three years.

 

Who Can Apply for an H-1B Visa?
The applicant for an H-1B visa is a U.S. employer, not the employee. The employee is the beneficiary of the H-1B application. Both the employer and employee must meet specific requirements:

Employer:

  • Must demonstrate a genuine employment relationship with the foreign employee.

  • Must have the ability to pay wages.

  • The job position offered to the foreign employee must be a legitimate position.

Employee:

  • Job Position: The position held by the beneficiary should be a "professional position," typically requiring at least a bachelor's degree or higher; or the job is so specialized and complex that only an individual with a degree can perform the duties.

  • Educational Background: Possess a bachelor’s degree or higher degree from a U.S. accredited university, or its foreign equivalent.


How Long Does it Take to Approve an H-1B Application?
Generally, USCIS requires 3 to 6 months to process an H-1B visa application, starting from the date the application is received.

What Are the Fees for Applying for an H-1B Visa?(subject to change)

  • Electronic Registration Fee: $10

  • I-129 Application Fee: $460

  • Fraud Prevention and Detection Fee: $500

  • Education and Training Fee: $1,500 for employers with 25 or more full-time employees; $750 for employers with fewer than 25 full-time employees. Note: Non-profit organizations, governmental research organizations, educational institutions, etc. are exempt from this fee.

Optional Fees:

  • Expedited Processing Fee (Premium Processing): $2,500

  • Public Law 114-113 Fee: $4,000 if the employer has 50 or more employees in the U.S., and more than half of these employees are in H-1B or L-1 status.
