Asylum

What is Asylum?

Asylum is a legal protection afforded by the United States to people who have suffered persecution, or fear that they will suffer persecution due to race, religion, nationality, membership in a particular social group, or political opinion.

Who may be qualified for Asylum?

Any person who is unable or unwilling to return to their home country because of persecution or a well-founded fear of persecution due to the above reasons, provided that he/she also meets the following criteria is qualified to apply for asylum.

  • The individual must apply for the asylum within one year of entering the U.S. or he/she is qualified for some exceptions to the deadline.

  • The asylum application can only be made once the individual is physically present in the U.S.

 

What is the benefit of asylum?

Once an individual has been granted asylum status, he/she will be able to:

  • Live, work, and attend schools anywhere in the United States.

  • Petition for his/her spouse and unmarried minor children to come to the United States.

  • Apply for permanent residence (Green Card) and eventually obtain the United States citizenship.

  • Travel outside of the United States.

 

What is Asylum Processing Time?

  • Within 21 days after USCIS receives your application, you will receive a receipt notice confirming that the applicant has been received.

  • In about 1 to 2 months after USCIS received your application, you will receive a biometrics appointment notice.

  • Within about 6 months, you will be interviewed at 1 of the 8 U.S. asylum offices.

  • Generally, within 2 weeks after the asylum officer interviewed you, USCIS will notify you to return to the asylum office to pick up the decision. In some rare situations, USCIS will mail the decision to you.

 

What are the application fees?

  • No filing fees.

  • No biometric fess.

  • Translation: Approximate $500-$800.

  • Form I-485 Adjustment of Status including Form I-131 Application for Travel Document and I-765 Application for Employment Authorization: $1,225 per person greater than 14 years old; $750 per person under 14 years old. (subject to change)
